Permanent residence is granted in a named category under the Immigration Act. Time in the Republic, without more, is not enough.
Permanent Residency
Permanent residence allows the holder to remain in South Africa without renewing a temporary visa. It is granted only in a category under sections 26 or 27 of the Immigration Act — time spent in the Republic, without more, does not confer it.
The application is lodged in person, preferably inside South Africa through VFS, so that a tracking number is issued. The category must be chosen correctly; a file in the wrong category is not a near-miss, it is a refusal. Once granted, the holder must apply for a South African identity document. Permanent residence is not citizenship: it does not confer the vote or a South African passport.
Proof of Permanent Residency
A permanent-residence certificate is issued once. Keep the original and a certified copy. If the certificate is lost, apply for confirmation of status — a letter that records the same standing.
The conditions printed on the certificate must be complied with. Leaving South Africa for three years or more places the status at risk of revocation. We advise on confirmation of status, certified copies, and travel that might be read as abandonment.
PR — Spouse
Permanent residence on spousal or life-partnership grounds requires a genuine relationship of at least five years, with evidence of cohabitation and shared financial responsibility. The relationship must be exclusive, and the applicant must show good character. Life partnerships, including same-sex partnerships, are recognised.
Applications are lodged in person through VFS in South Africa or at a mission abroad. After five years as a permanent resident, and subject to the conditions of the certificate, naturalisation may be considered. We build the relationship evidence to the same standard the Department applies on a temporary spousal file, then carry it through to permanent residence.
PR — Retirement
Permanent residence for retirees is for applicants who intend to remain indefinitely and can show prescribed income without having to work. The temporary retired-person visa is typically four years, renewable; permanent residence is the later step once the income test is met on an open-ended basis.
A permanent resident has the rights of a citizen save for the vote and a South African passport, and may remain indefinitely. We treat the temporary and permanent retirement files as one plan, not two unrelated applications.
PR — Financial Independence
The financially independent category is aimed at high-net-worth applicants. There is no age limit and no requirement to have already lived in South Africa. A clean criminal record, good character, and proof of sufficient resources are required.
The ordinary financial threshold is a net worth of at least R12 million, with the prescribed payment to the Department. Direct investment of that sum into a South African business is not itself the test. After grant, the holder must establish residence within a year and visit at least once every three years. Dependants added after grant are a separate process.
Citizenship
A permanent resident of five consecutive years or more may apply for naturalisation under the South African Citizenship Act. The ordinary criteria include: age 18 or over; lawful permanent residence; ordinary residence in the 12 months before the application and a total of four years’ residence in the preceding period; good character; an intention to remain; an official language; and knowledge of the responsibilities and privileges of citizenship.
Unlike permanent residence, naturalisation is lodged at a local Home Affairs office. The Department’s fee is R300. Where the Department does not decide, delay is a court matter — that work sits with Immigration Law Consultation.
Lithuanian Citizenship
South African families with Lithuanian lineage may have a descent claim to Lithuanian citizenship. The file is documentary: birth, marriage, and archival records that connect the applicant to a Lithuanian ancestor, then the application to the competent Lithuanian authority.
The full note on how those claims are built is on the firm’s guide, Lithuanian citizenship by descent. We take the South African civil documents and the foreign file together so the descent chain is proved once.
Retirement in South Africa
Retirement in South Africa is usually a two-step instruction: a retired-person visa first, then permanent residence on retirement or financial-independence grounds when the income or net-worth test is met. The temporary visa is renewable; permanent residence removes the renewal cycle.
Spouses and dependent children are planned in the same instruction — study visas for school-age children, a spousal or visitor endorsement where that is the better fit. We map the income evidence once and use it for both stages.
